kaibigan.

- ang taong nakakasama at nakikipag-tawanan araw-araw , madalas kahit saan pa? or vice versa

(isa lang talaga ang pipiliiin) (edited narin according to Skysenshi's good point)

(in inches)

neck 19
biceps 16.5
height 6 feet 5.5 inches
chest 52
buttocks 47.5
calf 19
waist 40.5
thigh 26.5
(source:Men's Health)

name that boy!

"Sir, ano pong APELYIDO nyo?

Moral of the story:

Say NO! to TOKYOPOP Pilot Program

Perhaps some of you have already heard of Tokyopop's Manga Pilot Program.
Its supposed to be a platform for aspiring manga artists to 'break-in' to the industry. It works like this:
1.) you make a 24-32 page orginal manga and you send it over to them, and once they select your work,
2.) they'll pay you for it and put it online with other mangas they have selected for that period of time,
3.)and then let the online readers decide who gets to continue their story and
4.)have Tokyopop pay them to do it.

Now, since Tokyopop is supposedly a legit and respectable company, you'd expect a fair and no-nonesense contract from them regarding this Manga Pilot Program. IN FACT, they claim to not want to confuse the creators with all the legal mumbo jumbo that they created the contract in a layman friendly manner to show that they mean well. You can read the contract here.

After reading this, all I've got to say is that what this new Program is nothing but a means for them to exploit naive artists into signing away their stories and characters for a mere $20 a page. (Sure, it may sound ok to us here, but that $20 is for a Inked, scanned, colored, ballooned, and lettered page that has gone through their editing and approval)

How messed up is the contract? Here are some excerpts:

  • You promise to protect us from claims anyone makes that you violated their rights in connection with your Project or Manga Pilot. This means you’ll pay for all the lawyers to fight it out and all the other costs necessary to fend off those claims, in or out of court. And, if things do get ugly and end up going to court, this means you’ll also pay for all the expert witnesses and court costs and, if the other guy or gal wins, you’ll pay whatever the court awards them, too
    • (This means should any lawsuit happen, you shoulder ALL legal payments. AND, bare in mind that the lawsuits will take place in USA, meaning you pay $ instead of peso. So, the $20 don't feel so big now, eh?)
  • GIVING US ADAPTATION RIGHTS
You give us the right to reformat, adapt, and modify the Manga Pilot for iManga, our motion graphics video format, as well as for other ways that we may change it in order to display, print, and exhibit it.
    • (Basically they'll pay you for the pages you do. But if they make shirts, animations, cards or other merchandise, you get nothing!)

  • MORAL RIGHTS” AND YOUR CREDIT
“Moral rights” is a fancy term (the French thought it up) that basically has to do with having your name attached to your creation (your credit!) and the right to approve or disapprove certain changes to your creation. Of course, we want you to get credit for your creation, and we want to work with you in case there are changes, but we want to do so under the terms in this pact instead of under fancy French idea. So, in order for us to adapt the Manga Pilot for different media, and to determine how we should include your credit in tough situations, you agree to give up any "moral rights" you might have.
Of course, you still have your rights under this pact to your credit.
    • (They want YOU to give up your moral rights coz it's UNCOOL and want you to adapt the stipulations in this contract instead. Wow...)

  • WHAT WE CAN DO WITH YOUR CREDIT
And, speaking of your credit, customarily we give you credit for your work as the writer and/or artist of the Manga Pilot. However, we may have to shorten or leave out your credit when the space available or the conventions of a format won’t permit it or if it would have to be too small to read (for example, when the Manga Pilot is viewed on mobile phones). You’re OK with this.
    • (They are not obliged to credit you on your work if it inconveniences them.)
  • AFTER THE EXCLUSIVE PERIOD OF THIS PACT ENDS
Once the Exclusive Period ends and even if you and we haven’t entered into an Original Property Agreement, we’ll still have the worldwide right, continuing forever, to publish the Manga Pilot on a non-exclusive basis.
    • (They basically have the right to publish your pilot and not pay you a cent FOREVER!)
  • The contract also states that payment will ONLY be given once they have recieved AND accepted your comic. And since accepting is a subjective perrogative on their part, if they don't like a part of your story, you'll have no choice but to change it or revise it, or you will not get paid.
It's sad that even big companies such as this still try to pull the rug off naive creators by coming up with these bogus contracts. A lot of other people share their sentiments about this matter, and it is only right to try to spread this to as many people as possible as well.  I strongly advise you all to stay away from this, no matter how alluring it may seem at first, it really isn't worth the future problems and heartache you may entail because of this.

Do check out the links, read the contract for yourself, and perhaps blog hop a bit to get the pulse of other people's reaction towards this. It pays to be informed.
